Buyer Terms of Use

These terms govern your use of the Althemax marketplace at www.althemax.com, the public agent API, and the AI shopping chat (collectively, the “Service”). By browsing, signing in, completing a purchase, or instructing an AI agent to act on your behalf on the Service, you agree to these terms. If you do not agree, do not use the Service.

1. Who these terms cover

“You” means any individual shopper, organisation, or AI agent acting on behalf of a human buyer. “We”, “us”, “Althemax” means the operator of the marketplace.

2. The marketplace, not the seller

Althemax is a marketplace surface. Products listed on the Service are sold by independent merchants (“Sellers”). Unless you specifically purchase through an Althemax-hosted checkout, your order is fulfilled by the Seller, your payment is processed by the Seller's payment provider, and any contract of sale is between you and the Seller.

Althemax is not a party to the sale and does not warrant Seller products, descriptions, availability, pricing, fulfillment, shipping, returns, or after-sales support. Refer to the Seller's own terms, refund policy, and contact channels for issues with a product or order.

Cancellations, returns, refunds, and warranty claims are handled by the Seller under the Seller's own policy. We will help facilitate but do not adjudicate disputes between you and a Seller. Contact the Seller directly; copy us at enquiry@althemax.com if a Seller is unresponsive.

The Althemax name, logo, marketplace UI, agent API design, and original content are ours. Product listings, photos, and descriptions belong to the Sellers (or their licensors). You receive a non-exclusive, non-transferable, revocable licence to view the Service and to use the agent API in accordance with these terms.

Our handling of your personal data is described in the Privacy Policy. By using the Service you consent to that policy.

11. Disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or free of errors, that data shown is complete or accurate, or that any AI-generated description, recommendation, or summary is correct in every detail. AI agents may make mistakes; verify before you buy.

12. Limitation of liability

To the maximum extent allowed by law, Althemax and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising from your use of the Service. Our aggregate liability to you in any 12-month period will not exceed the greater of (a) GBP 100 and (b) the sum of fees you paid Althemax in that period (which is typically zero — Sellers fulfil and charge for orders directly).

You agree to indemnify and hold Althemax harmless from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your breach of these terms, or your violation of any third-party right.

14. Suspension and termination

We may suspend or terminate your access at any time, with or without notice, if we believe you have breached these terms, are abusing the Service, or are putting other users at risk.

15. Changes to these terms

We may update these terms from time to time. Material changes will be communicated by updating the “Last updated” date and, where appropriate, by notice on the marketplace. Continued use after a change means you accept the updated terms.

16. Governing law and disputes

These terms are governed by the laws of England & Wales. The courts of England have non-exclusive jurisdiction over any disputes, subject to mandatory consumer protection rights in your country of residence.
